This contest is intended for Newfoundland and Labrador and shall only be construed and evaluated according to Canadian law.
1. HOW IT WORKS: The promotion begins June 25th, 2009 and runs until August 31st, 2009 at 12:00 AM Newfoundland Standard Time (the “Contest Period”).
Beginning on June 25th, 2009, individuals may enter the contest by uploading a video file or written text entry through the forms provided on the Make Your Mark website contest page. Individuals who tell us how they would like to improve their community will be judged and one winner will be chosen.
2. PRIZES: The Winner will receive an Apple laptop for personal use and an Apple desktop donated to the school of their choice in their name. Winners will be selected by an eleven person committee consisting of seven individuals from the Department of Municipal Affairs, and a representative from Municipalities Newfoundland and Labrador, Futures in Newfoundland Youth, the Women’s Policy Office and a representative from the volunteer sector.
3. ELIGIBILITY: Open to legal residents of Newfoundland and Labrador, who are legal voting age or older. All Federal, Provincial and local laws and regulations apply. No cash equivalent, transfer or substitution of the prize is permitted, except at the Municipal Affairs discretion in the event of unavailability and in such event, a prize of equal or greater value will be awarded.
Prize acceptance constitutes permission to use the recipient’s name and/or likeness for advertising or trade without further compensation, unless prohibited by law. Recipients of prizes assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Municipal Affairs provides no warranty of any kind for prizes. If any prize is returned as undeliverable, prize will be forfeited.
By participating in the contest, you also agree to release and hold Municipal Affairs , its employees and all prize suppliers harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the contest, or resulting from acceptance, possession, use or misuse of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, whether suffered by you or a third party.
4. CONTACTING WINNERS: Municipal Affairs will contact winners only by e-mail within two hours of the selection (The Winner Contact Period). If a winner is disqualified from eligibility or cannot be contacted by Municipal Affairs within the Winner Contact Period, or if the winner fails to respond to the expiry date contained on the notifying email, Municipal Affairs will have the right to award the prize to another entrant. Municipal Affairs will not be liable in connection with the disqualification of any entrant or failure to contact a winner within the Winner Contact Period. Refusal to accept any prize releases Municipal Affairs of any obligation towards the winner.
5. CONTEST RULES, TERMS & CONDITIONS: Municipal Affairs reserves the right to modify scheduling of the contest without prior notice. Contest rules are subject to change without notice, if necessary, to comply with any applicable law or policy of Municipal Affairs, or any other entity having jurisdiction over Municipal Affairs.
Municipal Affairs is not responsible for any typographical or other error in the printing, the offering or the announcement of prizes. Municipal Affairs is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Municipal Affairs reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. In the event of termination, all remaining prizes will be awarded in a random method to be determined by Municipal Affairs.
Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any such contestant to the fullest extent of the law.
By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges whose decisions are final.
Municipal Affairs reserves the right to change contest prize details at any time as necessary during the promotional period.
Neither Municipal Affairs, its agency, or service provider/host are responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic.
In the event any portion of this Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of the Municipal Affairs, its agency or service provider/host, which in the sole opinion of the Sponsor, corrupts or impairs the administration, security, fairness or proper entry into the contest, the Sponsor reserves the right, in its sole discretion, to suspend or terminate the Contest and to award Prize(s) to individuals selected at random from the pool of Entrants received up to the point of termination, if a computer virus, bug, tampering, authorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Contest. In no event will more Prizes be awarded than those listed in the Contest Rules and Regulations.
